Attorney Generals' offices from 43 of 50 states and Guam have partnered with the Ad Council and the National Highway Traffic Safety Administration (NHTSA), to launch a new ad campaign and website to aimed at the prevention of texting and driving. The website, www.stoptestsstopwrecks.org, targets young adult drivers and aims to show them the consequences of this seemingly benign behavior. The campaign features Public Service Advertising (PSAs) in TV, radio, outdoor and web, as well as integrated digital and social media platforms. All advertising drives consumers to StopTextsStopsWrecks.org where consumers can find tips and tactics for how to curb this behavior.

This is another collaborative effort from different government agencies working together to help promote the dangers of texting and driving. As I have said before, it seems the public has been somewhat slow grasping the dangers of texting and driving, which is similar to the lackluster reaction people had toward the seat belt laws enacted in the 1960s. Hopefully campaigns like these continue to spread the word about the dangers of cell phone use while texting and driving.

'Directed Traffic Safety Initiative' Could Set Record For Tickets Issued

The Naperville Sun recently reported that the 'Directed Traffic Safety Initiative' - - which is in its' sixth year - - will probably break a record for the number of traffic tickets issued. The initiative, which includes the Naperville, Aurora, Bartlett, Hoffman Estates, Joliet, Plainfield, Shorewood, Streamwood, Warrenville and West Chicago police departments, is aimed at promoting traffic safety, which in turn, will hopefully lead to fewer car accidents.

This year the initiative posted police officers along Route 59 where Naperville police issued 182 tickets.

That tally is likely to double and perhaps more than triple once final statistics are compiled and submitted by the other 14 police agencies that participated in the annual initiative. Naperville Police Sgt., Lee Martin, was somewhat discouraged with the number of tickets as they had let the public know about the initiative through various media outlets. “We’d actually like for the totals to have been lower,” said Martin, who supervises his department’s traffic unit. We were hoping people would pay more attention than this. Despite our best efforts to warn people ahead of time and during the event ... it looks like it might be a record day for enforcement totals,” Martin said.

Martin said Naperville police issued 93 seat belt-related citations; 47 speeding tickets, including one to a motorist driving 83 mph in a 45 mph zone; 15 citations to motorists driving without insurance; and four to unlicensed drivers. The remaining 23 tickets were issued for a variety of other infractions, he said.

New Contest To Promote Anti-Distracted Driving Campaign For Teens

A smart new campaign has been introduced by the National Road Safety Foundation and NSSP (National Student Safety Program), which is offering a $1,000 scholarship to the winning teen who creates the best idea for a public service announcement. Three runner ups will receive a $500 scholarship. The aim of the PSA is to convince other teens to put down their phones when driving.

"A quarter of all teens admit to texting behind the wheel and, in 2009, the highest proportion of distracted drivers in fatal crashes was under the age of 20," said U.S. Transportation Secretary Ray LaHood. "We know we have to engage teens in order to put an end to distracted driving. With their help, we can educate teens and adults about making smarter choices that will save lives."

This is a clever program, which I think could have a huge effect on young people if done right. Kids listen to each other first. If the PSAs are authentic and not made in a corny way, then I think this could go a long way in curbing texting and driving.

2011 Brings New Traffic Law In Illinois

The new year is upon and there a few changes for Chicago drivers. Despite numerous complaints about red light cameras, and their effectiveness, they have not been eliminated in Illinois. Despite the complaints the Illinois legislature did make some changes. First, cities will have to post the locations of red-light cameras on the internet, and violations must be reviewed by a law enforcement officer.

Probably the biggest change is for excessive speeding violations. Motorists who are caught driving over 40 miles per hour the speed limit are no longer eligible for Court supervision.* Supervision is a fair method of punishment that Courts use for traffic violations and other crimes. As long as the violator pays the fine and court costs and does not commit any other traffic violations or crimes during the supervision period (typically 1 to 6 months), then the charge is dismissed from their record as if it never occurred.**

*Please note that the States or City Attorney or even the judge does have the discretion to amend a ticket to a lower speed violation so that the driver does become Supervision available. This is not guaranteed but the odds are better if the driver has a clean driving record (i.e. no previous tickets or none within the last few years)

* *Please note that supervision is becomes a little more complicated when a commercial drivers license (CDL) is involved as supervision is considered a conviction for CDL drivers and they can lose their license and ability to drive commercially if they receive supervision.

Designated Driver Services Popping Up In Chicago Area

The Chicago Tribune wrote an interesting article yesterday regarding designated driver services devoted to driving people to and from parties and/or bars. This is a new trend that appears to be timely considering the holiday season that is upon us. There are several components to this service that differentiates itself from a taxi or your typical "limo' driving service. First is the price. These designated driving services appear affordable as they typically only charge $12.50 per hour or $25 if you have already arrived to your location. Second, is that the designated drivers use the client's automobile to drive them to and from their destination. (This eliminates an often common worry about leaving your car somewhere away from home for the night and having to retrieve it the next day.) Third, if the client is going to a party, say in the suburbs, this type of service is much more accessible than trying to hailing or calling a cab to a subdivision.

Some of the new companies that have popped up recently include Paddy Wagon Services of suburban New Lenox, Booze Crews serving DuPage County and U Drink I Drive of Chicago.

Illinois Traffic Fines Increase This Week

It just became much more expensive this week for Illinois traffic violators. The new Illinois traffic laws went into effect on September 15 The new fines for minor offenses such as speeding up to 20 mph over the limit, running a stop sign or making an illegal turn will carry a $120 penalty, up from $75, under rates set by the Illinois Supreme Court. Topping the speed limit by 21 to 30 mph will cost $140, up from $95.

The increase in fines is the first since 1993, said Champaign County Circuit Court Judge Jeffrey Ford, chairman of the Supreme Court subcommittee that recommended the increases.The panel investigated the cost of speeding tickets in other states and found that Illinois' were lower, Ford said. "We were a bargain," he said.

The set increases apply only to offenses that don't require a court appearance. The cost of many tickets requiring a court date — such as speeding more than 30 mph over the limit — will also go up. But those hikes aren't definitive because a traffic court judge decides the fines.

A traffic violation cash penalty actually represents a bond rate set by the state Supreme Court. The bonds for minor offenses are accepted as fines for convenience's sake, Ford said.

I think it's fair to say that the increased fines were intaled to raise more revenue for the state but we will see if it acts as a deterrent to drivers and if it actually decreases the amount of car accidents .

NHTSA Reports Study On Drinking And Driving

The National Highway Transportation Safety Administration released some startling numbers regarding drinking and driving in their report titled: "National Survey On Drinking and Driving Attitudes and Behaviors." The survey concluded that and estimated 17 million motorists in the U.S. may have driven while drunk in the preceding 12 month and twenty percent of the public 16 and older had in the past year driven a motor vehicle within two hours of drinking alcohol. About two-thirds of these, or 13 percent of the total population 16 and older had done so in the past 30 days. The survey produced an estimate of 85.5 million past-month drinking-driving trip, up from 73.7 million trips in 2004.

The scary part of the of this survey is the resulting damage that these drinking and driving trips have caused. Among persons 16 and older involved in a motor vehicle crash in the past two years, 20% reported that someone had been injured in the (most recent) crash. Respondents were more likely to report that an involved driver had been drinking alcohol if the car crash led to injury (32%) than if no injury occurred (5%).

About 1% of the population 16 and older had been arrested for a drinking and driving violation in the past two years; the percentage was 5% for males 21 to 24. Almost three-fourths of the public believed that drivers who had too much to drink to drive safely would be somewhat likely (40%), very likely (21%), or almost certain (12%) to be stopped by police.

Illinois Legislature Look To Update Motorist Laws

The Illinois legislature and Governor Quinn are closely scrutinizing current driving statutes, including, the red light camera tickets and excessive speeder violations.

The proposed speeding measure would prevent a driver from getting court supervision if found guilty of going 40 mph or more faster than the speed limit. Supervision is a form of probation that allows a person to wipe a violation off of his driving record if he doesn't get another ticket for a specified number of months."There is nobody that needs to go 105 miles an hour to go anywhere," said John D'Amico, D-Chicago. "When you're driving that fast, you are truly putting other people's lives at risk, as well as your own."

The proposed red-light legislation, would ban the city and suburbs from tacking on a fee to the standard $100 fine if a ticket is appealed, a common practice that deters many motorists from fighting the charges.

It also would give drivers more wiggle room to creep up to the edge of an intersection before stopping. A complete stop still would be required before making a right turn on red, but drivers could come to a halt after the painted stop line without getting a ticket as long as pedestrians were not nearby. Drivers awaiting a green light to head straight into an intersection also could stop past the line without being nabbed by a camera.

Both of these measures are awaiting Governor Quinn's signature, but I have no doubt these will be signed as they were approved on overwhelming fashion.

It is good to see the state legislature take some action on the often scrutinized red light camera tickets. We will see if these measures actually make our roads and highways safer.

Chicago Employee Red Light Tickets Are Being Dismissed

I have written about the controversy of red light cameras in the past. There have been mixed reviews on their effectiveness. I have received one of these tickets and I have had numerous clients call me about taking care of these traffic violations. Unfortunately there is not a lot anyone or an attorney can do as they are a non-moving violation. Although, one can request an administrative hearing to challenge the ticket. This is an uphill battle as they are facing videotaped and photographed evidence of the violation.

Now more controversy surrounds the red light cameras in Chicago. The Chicago Sun Times reports that a large portion of red light camera tickets issued to city employees have been dismissed.

Since January 2007, 2,685 red-light-camera tickets have been issued to vehicles registered to city departments. At $100 a pop, that should have generated $268,500. Instead, only $77,167 has been collected.

1,830 of those tickets were dismissed for reasons that include the municipal code exemption for emergency vehicles. Not all of those vehicles were responding to emergencies with lights flashing and sirens blaring. Some police vehicles were working undercover. Some were vehicles assigned to city departments not typically considered emergency departments.

A Third Of Cook County Fatalities Linked To Drunk Driving

The Chicago Sun Times recently released car accident fatality statistics , which showed that from 1994 to 2008, one third of all Cook County car accident fatalities were related to drunk driving. The analysis was performed by Scripps Howard New Services.

As part of the project, Scripps Howard researchers counted the number of deaths on every road in America, using data provided by the U.S. Department of Transportation. Scripps analyzed 562,712 fatal accidents from 1994 to 2008 that claimed 627,433 lives.

While the carnage has fallen in recent years -- 37,261 individuals died in vehicular accidents in 2008 -- that's still more than 10 times the number who died in the attacks on Sept. 11, 2001.

Most of the traffic fatalities can be attributed to excessive speed, alcohol-impairment or failure to wear seat belts. Drivers distracted while texting, eating or using their cell phones are also a growing concern.

"People may feel more comfortable drinking and driving in rural areas, thinking that they are not as likely to get caught as on major roads," concluded Lee Munnich, director of the Center for Excellence in Rural Safety at the University of Minnesota.

IDOT And Illinois State Police Kick Off Drunk Driving Campaign

On February 4, The Illinois Department of Transportation announced its new impaired driving campaign with the Illinois State Police. The program is titled Buzzed Driving is Drunk Driving. The timing of this campaign is an attempt to prevent drunk driving during Super Bowl weekend, which is notorious for football fans being out and about at various parties and watering holes.

"Throughout Super Bowl weekend, the Illinois State Police will remain diligent in enforcing driving under the influence and the other fatal five violations, including speeding, safety belt use, improper lane usage and following too closely,” said Illinois State Police Director Jonathon Monken. “Law enforcement recognizes the big game brings fans together to celebrate, and alcoholic beverages are often part of the celebration. If you choose to drink, don’t drive. Ask someone to be a designated driver prior to starting your celebration or call a taxi service to make sure you arrive home safely.”

The Illinois Department of Transportation’s Division of Traffic Safety suggests the following tips for those planning to consume alcohol while watching the Super Bowl:

Designate a sober driver before the party begins;
Call a taxi, use mass transit, or call a sober friend or family member to get you home safely;
Use your community’s designated driver program, if established;

Report impaired drivers to law enforcement;
Spend the night where the activity is being held and sleep it off;
Always buckle up – it’s your best defense against an impaired driver.

Lawsuit Filed Against Lockport Police Officer For Fatal DUI Accident

A Lockport police officer, who allegedly made a deadly mistake by drinking and driving, is now facing a wrongful death lawsuit.

The family of a Chicago man, who was killed Dec. 20 when an allegedly intoxicated off-duty Lockport police officer crashed into his car, has filed a wrongful death lawsuit, seeking more than $20 million.

Man Wong, 29, 2417 S. Wentworth Ave., died in the crash on the Stevenson Expressway near Central Avenue in which police officer Edward Stapinski was charged with reckless homicide and aggravated drunken driving.

Stapinski, 34, of Lockport, was southbound on the Stevenson about 9:30 p.m., when he lost control of his car, struck the concrete median barrier and went over the median into the northbound lanes, where it struck a car driven by Wong, according to state police.

Named as defendants in the lawsuit, filed Tuesday in Cook County Circuit Court, are Stapinski, WestEnd Bar and Grill in Chicago, where Stapinski allegedly was drinking before the crash, and the Four Corners Tavern Group, which operates the bar.

The lawsuit claims that Stapinski was "severely impaired" after drinking alcohol at the tavern and that his blood-alcohol level was recorded at a hospital at about three times the legal limit.

Depending on Officer Stapinski's insurance policy, this may be a case where an underinsurance or uninsured claim is made.

May Suggests Offering Chicago Parkers A Grace Period For Parking Tickets

Chicago Mayor Richard Daley recently announced to the press that he would consider offering parkers a chance to fight parking tickets once a year. The suggestion would only apply if the ticket is issued within five minutes after meter expires.

The mayor said his gesture is in line with a long-standing City Hall message to parking enforcement to not cite cars when the meter has just expired.

Daley's proposal was an olive branch to residents still fuming over the parking meter lease deal and the consequential spike in parking meter rates.

"I understand that many people were angry over the way the parking meter plan was implemented last year," Daley said, according to the Chicago Tribune. "This grace period is another step by Chicago parking meters to improve the parking meter system and add convenience for motorists."

There is nothing more frustrating than receiving a $50 or $100 parking ticket minutes after your meter has expired. I will believe this offer when I actually see it.

Family Mourns Victim Of Hit And Run Accident

Chicago has been plagued by several pedestrian related auto accidents the past few weeks. Chicago Breaking News reported recently that the family of Maria Worthon, who was struck and killed by a vehicle in her Rogers Park neighborhood last week, mourned at her funeral.

Maria Worthon, a nursing assistant, was remembered at a church across the street from where she was fatally struck by a car on Dec. 21 while walking with her son, Jerermiah, who also was hit.

The 6-year-old boy made it out of the hospital in time to attend his mother's funeral. An uncle picked him up to get a last glimpse of his mother before the casket was closed.

"I got better, because I (saw) her," the boy said at the service.

The driver in the hit-and-run was fleeing police at 70 to 80 mph and did not stop or slow down after striking Jeremiah and Worthon, who died at the scene in the 7000 block of North Greenview Avenue.

Ralph Eubanks, whom authorities said had traces of cocaine, ecstasy and marijuana in his blood, was ordered held without bail last week on charges of first-degree murder, aggravated DUI and leaving the scene of a fatal accident.

"This stinks," Rev. Deborah Patton said during Worthon's eulogy. "Maria's death in particular was thoughtless, unnecessary and irresponsible."

This is very sad news for Ms. Worthon's friends and family. I think we can foresee a wrongful death lawsuit against Ralph Eubanks. This is a dangerous time of year to be on the roads for both drivers and pedestrians. Remember to be careful. There are a lot of crazy drivers out there.

Illinois Ranks Eighth Deadliest State For DUI Fatalities

The National Highway Safety and Traffic Safety Association (NHSTA) released the 2007 and 2008 data for alcohol related highway deaths. Unfortunately, Illinois ranked as the eighth deadliest state.

There was some encouraging news as 2008 compared to 2007, the overall fatality rate declined from 1.36 to 1.25 fatalities per 100 million vehicle miles of travel (VMT), and the alcohol-impaired driving fatality rate declined from 0.43 to 0.40 highway fatalities per 100 million VMT. From 2007 to 2008, the alcohol-impaired-driving fatality rate declined in 40 States, the District of Columbia and Puerto Rico and remained the same or increased in the remaining 10 States.

Impaired-driving laws have been enacted in all 50 States and the District of Columbia that make it illegal for a driver or a motorcycle rider with a BAC of .08 or above to drive a vehicle. In 2008, the alcohol-impaired-driving fatality rate declined from 0.43 highway fatalities per 100 million VMT in 2007 to 0.40 in 2008.

Hopefully 2009 statistics will show a decline for Illinois and the stricter DUI laws led to safer for roads.

Transportation Secretary LaHood Lauches Holiday Crackdown On Drinking and Driving

USA Today recently reported Transportation Secretary Ray LaHood is launching a national crackdown on DUI and Drinking and Driving during the holiday season.

"Our feeling is in states where you have real tough law enforcement, where the law enforcement people are no-nonsense, those are the states that have been able to reduce their numbers," LaHood said. "In states where they don't have tough law enforcement, or they don't do it as aggressively as other states, the numbers are not that good."

According to the National Highway Traffic Safety Administration, the drunken-driving fatality rate in the USA declined about 7% from 2007 to 2008, continuing a decades-long drop. Drunken-driving deaths have been trending downward since 1982, two years after Mothers Against Drunk Driving began focusing attention on the issue. There were 11,773 such fatalities in 2008, a 44% drop from the 21,113 in 1982, according to NHTSA and U.S. Department of Transportation data

LaHood, White House drug czar Gil Kerlikowske and John Saunders of the Governors Highway Safety Association (GHSA) launched the annual national winter holiday crackdown on impaired driving. Thousands of law enforcement agencies across the USA will be targeting drunken driving in the campaign, which runs through New Year's Day. Each state has its own version.

Mothers Against Drunk Drivers Stresses Safe Parties Over Thanksgiving Weekend

Illinois Police To Increase Patrols Over The Holiday Season

The Illinois State Police have announced that they are going to increase their patrols over the holiday season to hopefully decrease the number of car accidents throughout the state.

Many departments are participating in a statewide initiative called Operation Save 100, aimed to decrease by 100 the number of vehicle-related fatalities in Illinois until Jan. 31, 2010.

“We’re going to do some saturated seat belt patrols, and we will be concentrating on various violations,” Spring Grove Police Chief Tom Sanders said.

He said increased seat belt use would safeguard travelers against winter weather conditions, as well as drunkdrivers heading home from holiday parties.

“When the conditions are icy and bad, it’s even more important,” Sanders said.

On the night before Thanksgiving, the McHenry County Sheriff’s Office would conduct two initiatives, one that focused on seat belt and car seat use and another that would target drunken driving.

The sheriff’s office is teaming up with Huntley Police and the Illinois State Police for the drunken driving enforcement.

Sheriff Keith Nygren credited such enforcement initiatives with contributing to the declining vehicle-related fatality rate in the county.

“Focused and intense traffic enforcement can make a difference, ... and that is what this is all about,” he said.

Repeat DUI Offender Injures 12 In Illinois Car Crash

A Morton, Illinois man was arrested after allegedly drinking and driving and causing a car crash that injured 12 other motorists. The car crash that sent 12 people to area hospitals occurred on Sept. 16

Jesse A. Horn, 23, of 119 E. Hazelwood St., Morton, was coming from the Morton Pumpkin Festival, where, according to court records, he was doing community service hours for a past DUI conviction.was charged with five felony counts by the Tazewell County State’s Attorney Thursday: unlawful possession of a converted vehicle, a Class 2 felony; three counts of aggravated driving under the combined influence of alcohol and drugs resulting in an accident causing great bodily harm, a Class 4 felony; and driving on a suspended driver’s license, subsequent felony offense, a Class 4 felony.

At the hospital after the accident, Horn was issued citations for DUI, reckless driving and driving on a suspended driver’s license. Those tickets were dropped so that the state could charge him with the felony counts, said Umholtz.

Umholtz said the Pumpkin Festival organizers are in no way to blame for the accident. He said Horn allegedly took the truck, loaned by Mike Murphy Ford in Morton to the festival committee, without permission.

Witnesses said that Horn was driving eastbound in the westbound lane when he encountered a Toyota truck waiting to turn onto Durant Street. As Horn was trying to get back into the eastbound lane and a Jeep was coming toward him in the westbound lane, the front of Horn’s vehicle hit the Toyota and the back of his vehicle hit the Jeep, which went into a spin and went into a cornfield on the south side of Route 150.

According to court records, injuries to some victims were serious. One man’s arm was broken in three places and required surgery to install pins to repair it. Another victim suffered rib and vertebrae fractures.

Illinois Traffic Safety Leaders Report Higher Rate Of Drunk Drivers Over Halloween

The Illinois Traffic Safety Leaders (ITSL) recently posted an article discussing the increase dangers of driving over Halloween and what can be done to keep you and your family safe.

The ITSL reported that According to the National Highway Traffic Safety Administration (NHTSA), in 2008, 58 percent of all highway fatalities across the nation on Halloween night (6 pm Oct. 31 to 5:59 am Nov. 1) involved a driver or a motorcycle rider with a Blood Alcohol Concentration (BAC) of .08 or higher, which is illegal in every state.

“One foolish decision can turn a fun Halloween into a real-life horror story,” said ITSL Vice-President
Mike Rompala. “There are simple precautions partygoers can take such as designating a sober driver in
advance or taking a taxi.”

ITSL also recommends these simple tips:
        Plan a safe way home before the festivities begin;
        Before drinking, please designate a sober driver;
        If you’re impaired, and haven't designated a sober driver, use a taxi, call a sober friend or family
member, or use public transportation so you are sure to get home safely;
        Use your community’s Sober Rides program
        If you happen to see a drunk driver on the road, don’t hesitate to contact your local law enforcement

Man Arrested For Suspiscion Of Driving A Golf Cart While Intoxicated

Warning to all golfers: drinking and driving your golf cart can lead to a DUI arrest. An 18-year-old man arrested while driving a golf cart on the Route 309 bypass near Sellersville was heading to a campground several miles away, according to police.

Police say David G. Ruck, 18, was drunk when they stopped him around 8:20 p.m. Tuesday in West Rockhill Township. He was heading back to the Boulder Woods Campground in Milford Township from Souderton, a nearly 10-mile journey.

Pennridge Regional police charged Ruck with drunken driving, underage drinking and public drunkenness, and he was sent to Bucks County Prison under $500 bail.

Remember, a golf cart is considered a motorized vehicle and you can still be arrested for a DUI.

Former Lake County Judge's Blood Sample Will Be Admissible In Upcoming DUI Trial

A recent ruling came down for former Lake County Chief Judge, David Hall, who was arrested in April 2008 for suspicion of DUI. A Lake County Judge ruled last week that the blood sample taken from Hall on the night of his arrest will be admissible at his December trial. The sample showed a blood-alcohol content of over .08, the legal limit in Illinois.

Hall's attorneys argued Monday that the blood test should not be admissible in court, because of the time that lapsed between when it was drawn and tested, and because of the chain of custody the sample went through from the time it was drawn at the hospital to when it was taken to the Illinois State Police Crime Lab in Westchester 19 days later.

The argument fell short and the test results will be used at the December 14 trial.

Chain of custody is a crucial aspect of many criminal trials . First, it can ensure that evidence is not tainted or tampered prior to being entered into evidence at trial. Also, it keeps our prosecutors in check and ensures that they are doing their job ethically. We must always hold our prosecutors and police agencies accountable for the evidence they plan on introducing at trial. Regardless, the chain of custody in Hall's DUI case appears to have met that standard. Not even Chief Judges are not above the law.

Repeat DUI Offender Sentenced To 28 Years For Deadly Crash

A Granite City, Illinois man received the maximum prison sentence after being charged with his Sixth DUI that resulted in the deaths of a Granite City couple and their unborn child. Donald Canterbery received 28 years in prison after pleading guilty aggravated drunk driving and related charges.

Canterbery's blood-alcohol rate was 0.246 percent, which is more than three times the threshold for a drunken-driving charge in Illinois. According to an accident reconstruction report, police calculated Canterbery's 2006 Corvette was traveling 151 mph four seconds before the crash and 91 mph when it hit the rear of Arnold-Zimmer's Hyundai. The wreck happened on Illinois 111 just north of Interstate 55.

Canterbery had five prior arrests for driving under the influence. When given a chance to make a statement in court, he declined. Since the crash, he's been held in the Madison County Jail on $1 million bail. He will have to serve at least 85 percent of his sentence, State's Attorney Bill Mudge said.

"Twenty-eight years in the maximum sentence in this case. I am grateful that this came to a speedy conclusion, saving the families further heartache and grief that comes with a trial," Mudge said.

Kristi Hosea, a victim-services specialist with Illinois Mothers Against Drunk Driving, attended the hearing Tuesday.

"MADD's very pleased to see the maximum sentence come out of Madison County and we hope it sends the message that drunk driving will not be tolerated," Hosea said.

IDOT Reports That Late-Night Driving Is The Deadliest Time On Illinois Roadways.

The Illinois Department of Transportation recently announced that drinking and driving and low seatbelt use leads to higher accident rates late at night. Nearly seven out of ten fatalities occurring between midnight and 3 a.m. involve a drinking driver, and less than three out of ten of those who died in crashes during this time were properly restrained by a safety belt. The picture is completely different during the higher-traffic, daytime hours with less than two out of ten fatalities involving alcohol and nearly six out of ten properly restrained.

“Drinking and driving is inappropriate regardless of the time of day," said Illinois State Police Director Jonathon Monken. "Data tells us the likelihood of being involved in a crash or fatal crash where alcohol is involved increases dramatically at night. Therefore, the Illinois State Police will focus our efforts on DUI and seat belt enforcement during night time details."

According to data from the Illinois Department of Transportation (IDOT) and the National Highway Traffic Safety Administration (NHTSA), the midnight to 3 a.m. time frame is the deadliest time on Illinois roads. For the last four years (2005-2008) in Illinois, more motor vehicle fatalities occurred between midnight and 3 a.m. than any other time of day. Fatalities occurring from 9 p.m. to midnight were close behind.

Not coincidentally, the data also shows late night hours have by far the highest percentage of alcohol involvement. For the last four years (2005-2008), 67 percent of the motor vehicle fatalities occurring from midnight to 3 a.m. involved a drinking driver.

Equally troubling during the nighttime hours is the fact that motorists buckle up at a much lower rate. Data shows for the years 2005-2008, the midnight to 3 a.m. and the 3 a.m.-6 a.m. time frame had the lowest belt use involving motor vehicle fatalities with only 27 percent of those who died in crashes properly restrained. The 9 p.m. to midnight timeframe was second worst with only 32 percent of those who died were properly restrained.

Remember to keep your wits about you when driving late at night as the data clearly show that there are far more drunk drivers on the road. And, of course, always buckle up no matter what time of day.

Old Breathalyzer Machines Deemed Inaccurate By Experts

The Sarasota Herald Tribune recently reported that the State of Florida replaced the Intoxilyzer 5000 breath-test machines in 2006 with the Intoxilyzer 8000. Apparently, the Intoxilyzer 5000, which was used for about two decades, could not meet today's scientific requirements for ensuring accurate results. The Intoxilyzer 5000 was only checked once a month to see if the machine was working properly. The Intoxilyzer 8000 runs two control tests during every alcohol breath test one right before and one right after.

The testimony of those experts means prosecutors cannot present the Intoxilyzer 5000 breath tests in court in the small number of remaining cases where that older machine was used. As a result, dozens of DUI defendants in Sarasota and Manatee counties have had charges dropped or reduced to reckless driving. But it is too late for anyone already convicted with results from the Intoxilyzer 5000 to benefit from the situation.

Recent Study Shows Insurance Premiums Skyrocket After DUI Convictions

A recent study posted by carinsurance.com revealed that it is not only dangerous to drink and drive but it can also hurt your pocket book. The data disclosed by RateWatch and insurance.com showed that those who have been convicted of DUI or DWI pay, on average, 38 percent more per year on car insurance premiums than those who don't have a conviction.

Latest Data Shows Sharp Increase In Arrests Of Women For DUI

Proposed Boating Law Could Affect Your Driving Record In Illinois

A CBS 2 News report reveals a growing trend of drunken boating incidents in Illinois. Last year there were three fatalities on Illinois waterways that were related to boaters that were intoxicated. There have also been over 1000 arrests in the last year for for intoxicated boating.

This growing trend has led Illinois State lawmakers to introduce new legislation in Springfield that would affect peoples driving record the same same as a DUI if arrested for boating while intoxicated. Right now, no such arrest or conviction would affect someone's driving record. A bill introduced by Sen. Chris Lauzen has passed in the Senate and is waiting for approval from the House.

The lesson learned here is that drinking and boating can just as dangerous drinking and driving an automobile. Always have a designated boater when out partying on the water.

Cleveland Brown Donte' Stallworth Suspended For Season Without Pay By NFL

NFL Commissioner, Roger Goodell, continues his strict enforcement of the NFL's code of conduct policy when he ordered Cleveland Brown wide receiver, Donte Stallworth, suspended for the entire 2009 season without pay. Stallworth - - who pled guilty to DUI manslaughter on June 16 after striking and killing Mario Reyes on March 14 in Miami - - understands the decision and says he does not want his poor decision making to reflect badly on the NFL as a whole: "Obviously, I am disappointed, but, as I said previously, I accept the Commissioner’s decision. Regardless of the length of my suspension, I will carry the burden of Mr. Reyes’ death for the rest of my life. I urge NFL fans not to judge NFL players or me based on my tragic lapse in judgment. I am a good person who did a bad thing. I will use the period of my suspension to reflect, fulfill my obligations, and use this experience to make a positive impact on the lives of those who look up to NFL players."

Goodell has been criticized in the past for being very strict with his new power as NFL commissioner, but it appears he has made the right decision in this instance. The victim's family will never have Mr. Reyes back and it would have been hard for the NFL to explain why Stallworth was out catching passes on national TV on Sundays this Fall.

Ex-Chicago Police Officer Accused of Faking DUI Evidence

A former Chicago lawman has been named in ten separate lawuits for faking evidence in DUI cases. The lawsuits call into question ten DUI arrests he made by retired CPD officer, Joe D. Parker, on Lake Shore Drive in Chicago. The Chicago Police department has announced that they have dropped dozens of DUI charges based on arrests due to Parker's questionable conduct. Police spokesmen have not relaeased the the type of evidence that has been called into question.

U.S. Supreme Court Puts Hammer Down On DUI Prosecutions

The U.S. Supreme Court recently ruled that prosecutors can no longer rely on lab results, by themselves, when prosecuting DUI and drug cases. DUI defendants can now require the lab technician to testify live in court. This is a major shake up in the way DUI and drug cases will now be prosecuted, and appears to be a huge step forward in protecting individual rights as many defendants have been sentenced to prison in the past on faulty or dishonest lab results. Prosecutors can no longer use a piece of paper as a witness when prosecuting these types of charges.

Chicago Cab Driver strikes 2 homeless people, charged with DUI

A Chicago Cab driver was allegedly drunk when driving on Lake Shore drive in the early morning hours and struck two homeless people sleeping in a park. The driver, who was charged with DUI, allegedly missed his exit in the Uptown neighborhood, when his vehicle struck the two homeless people while they were sleeping in a park. Both people were reported to be in good condition.

The California Supreme Court Says that Defendants Can Challenge Breathalyzer Tests

U.S. Transportation Secretary Ray LaHood: Overall Traffic Fatalities Reach Record Low

The U.S. Department of Transportation today announced that the number of overall traffic fatalities reported in 2008 hit their lowest level since 1961 and that fatalities in the first three months of 2009 continue to decrease. The fatality rate, which accounts for variables like fewer miles traveled, also reached the lowest level ever recorded. The fatality data for 2008 placed the highway death count at 37,261, a drop of 9.7 percent from 2007. The fatality rate for 2008 was 1.27 persons per 100 million VMT, about 7 percent below the rate of 1.36 recorded for 2007.

Secretary LaHood attributed the following to record low in auto accident fatalities: increased seat belt use; curtailing impaired driving; making roads and highways safer; and maximizing vehicle safety.
